Waiver of Liability, Assumption of Risk Image, and Indemnity Agreement
Waiver of Liability
In consideration of being permitted to join Sun God Archery at UCSD (“SGA”) and participate in anyway in the SGA’s activities (hereinafter called “The Activities”), including, but not limited to, Events, Competitions, Joint Shoots, Practices, Workshops, Coach Education and Training, Fundraisers, and community service events, I, for myself and on behalf of my heirs, next of kin, representatives or assigns, do hereby release, waive, discharge, and covenant not to sue the SGA, its Board of Officers, Coaches, Instructors, staff, representatives, affiliates, volunteers, contractors, and agents from liability from any and all claims including the negligence of the SGA, its Board of Officers, Coaches, Instructors, staff, representatives, affiliates, volunteers, contractors, and agents, resulting in personal physical or psychological injury, accidents, illnesses, paralysis, death, and property loss arising from, but not limited to, participating in the Activities.
Assumption of Risk
Participating in The Activities carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injury. Specific risks vary from one activity to another, and can range from:
Minor injuries - scratches, bruises, sprains
Major injuries - Loss of sight, eye injuries, joint or back injuries, heart attacks, concussions
Catastrophic injuries - paralysis and death
and can include, but are not limited to physical and psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability, economic or emotional loss, and death.
I have read the previous paragraphs and I know, understand, and appreciate these and other risks are inherent in the Activities. I hereby assert that my participation is voluntary and that I knowingly assume both known and unknown all such risks.
Indemnification
I agree to indemnify and hold the SGA, its Board of Officers, Coaches, Instructors, staff, representatives, affiliates, volunteers, contractors, and agents harmless from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including any attorney’s fees brought as a result of my participation in the Activities and to reimburse them for any such expenses incurred.
Severability
The undersigned further expressly agrees that the foregoing waiver, assumption of risks, and indemnification are intended to be as broad and inclusive as is permitted by the law of the State of California and that if any portion thereof is held invalid or unenforceable, it is agreed that the remaining terms shall notwithstanding, continue in full legal force and effect.
Image Release
I irrevocably consent to and authorize the use by SGA of any and all photographs, videos, voice recordings, or other media taken of me including derivative works thereof (collectively, “images”) and any reproduction of them in any form in any media whether now known of hereafter created, throughout the world in perpetuity.
I consent to the use of my name and likeness, or an assigned fictitious name in connection with the exhibition, distribution, merchandising, advertising, exploiting, and/or publicizing of SGA. These uses in, but are not limited to, videos, publications, websites, news releases, emails, and any other promotional and educational materials in any medium.
I acknowledge that I will not receive any compensation for the use of such videos, images, likenesses, etc.
I hereby release and discharge SGA, its Board of Officers, Coaches, Instructors, staff, representatives, affiliates, volunteers, contractors, and agents from liability, from any and all claims, suits, or demands in connection to images or likenesses of me and the reproduction thereof as aforesaid. This includes claims for invasion of privacy, right of publicity, misappropriation or misuse of image, and defamation.
I agree that SGA will be the exclusive owner of all rights, including, but not limited to, in copyrights, in and to the images, in whole or in part, throughout the universe, in perpetuity, in any medium now known or hereafter developed, and to license others to so use them in any manner SGA may determine in its sole discretion, without any obligation to me..
This agreement is made and being entered into under the laws of the State of California and shall be governed and interpreted in accordance with the laws of the state. This agreement embodies the entire agreement of the parties (subject and photographer). No modifications of this agreement shall be of any effect unless it is made in writing and signed by all of the parties to the agreement.
I hereby waive any right that I may have to inspect and/or approve the use of the Images or any reproductions thereof, by SGA.
Acknowledgement of Understanding
I have read this waiver of liability, assumption of risk, indemnity agreement and Image Release, fully understand its terms, understand that I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to the extent allowed by the law.

Parents or Guardians of Minors
I, the legal parent or guardian of the participant, understand the legal consequences of signing this waiver of liability, assumption of risk, indemnity agreement, and Image Release, and fully understand its terms, knowingly giving up substantial rights, such as the right to sue on my and the participants behalf. I allow the participant to participate in the Activities and understand that I am responsible for the obligations and acts described above. I agree that I am signing this agreement freely and voluntarily, and intend my signature to be complete and unconditional release of all liability to the extent allowed by the law.
